It is agreed that the following T&Cs set out the total agreement made between both parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. A copy of these T&Cs will be emailed to you for your own records.
Booking Fee & Further Payments
A booking fee of £400 is charged at the time of booking in order to secure my services on the agreed wedding date. As soon as I receive this payment, your booking is complete and I will contact you via email to confirm. Payment is taken via bank transfer. Please note that the booking fee is a service charge for reserving a wedding date with me and is non-refundable under any circumstances. Following payment of the booking fee, the remaining balance will be due no later than 8 weeks prior to the wedding date. No photographic services will be provided until all payments due have been made in full. If the full balance has not been settled by the 8 week deadline, I reserve the right to start seeking potential alternative work on your proposed wedding date.
It is agreed that I may use any photographs included in this contract for my own promotional purposes. I may wish to submit a small selection of photographs to your wedding venue for them to display on their website/in print/on social media. Also, I may wish to enter single images into wedding photography competitions. If you have any reservations about the use of photographs in this contract, you are encouraged to discuss it with me in advance of booking.
When photographs are published online, it is appreciated if citation of ‘Neil Parry Photography’ is made somewhere in the post. You agree that you will not alter/edit/manipulate any of the photographs, especially those which you choose to post online. This includes the adding of photo filters or other effects. I need photographs that are supplied and posted online to be accurate representations of my work so that future clients have a good understanding of the type of photographs that they’ll receive.
If you choose to share any photographs with your other wedding suppliers, you must only submit the medium resolution files which carry my watermark. If you receive a request for full resolution and non-watermarked photographs, then please pass this enquiry on to me.
I will provide an accurate colour balance but cannot always guarantee exact colour matching due to the anomalous reflectance of some materials. All photographs are edited at my discretion. As standard, I will provide a mixture of both colour and black and white photographs in the edit (but most will be in colour). If you wish to receive all of your edited photographs in colour or all of them in black and white, this must be requested before I begin the edit in the days following your wedding. Further editing requests of any kind after I have delivered all of the photographs may incur an additional charge. Delivered photographs may not include all photographs shot on the day as I reserve the right to edit and release only those deemed creditable as professional in quality and within my artistic standards. Photographs determined to be substandard or duplicated will be edited out. I will use professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all photographs that will be made available to you. Some materials may reproduce differently printed, compared to the human eye. Every effort will be made to ensure colour accuracy and therefore colour matching will be deemed correct at my discretion.
Formal Group Shots
Formal group shots are optional. All formal group shot requests must be submitted to me in advance of the wedding date via email and must be kept to a maximum of 6 ‘priority’ combinations. If more formal group shots are required, this may be possible on the day, time permitting.
The 1988 Copyright Act assigns the copyright of all photographs to me and I continue to retain full copyright of all photographs after submitting them to you. I grant permission for you to use the photographs strictly for personal use. You have full printing rights. Commercial uses (this includes submitting any photographs to your other wedding suppliers) must be expressly approved in written form in advance by me and include citation.
I shall be granted artistic license in relation to the poses photographed and the locations used. My judgment regarding the locations/poses and number of photographs taken shall be deemed correct. In certain weather conditions, such as strong winds or heavy rain, it may not be possible to capture all of the photographs requested.
No guests or employees of yours may impede me when I’m shooting or performing my duties; failure to comply with this may result in missed moments and/or fewer delivered photographs. The responsibility of this will fall on you to ensure that all are in compliance. No other professional or semiprofessional photographers will be hired by you, your suppliers or the wedding venue for any point of the day, unless approved in advance of the wedding by me.
If you’re booking full-day coverage, I kindly request to be provided with a hot vegetarian meal please during the time of the wedding breakfast, served in separate room to the wedding party. Please inform me and the venue staff in advance of the wedding day if you plan to provide me with food. If no food is provided, I reserve the right to go off-site for at least one hour to seek a suitable meal. If your photography package includes a second photographer, please also include a meal for them.
Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
In the unlikely event of me not being able to attend your wedding due to unforeseen circumstances, you have the option of a full refund, or, I can appoint another photographer of equal experience and ability to attend your wedding on my behalf, to undertake the wedding photography. In the unlikely event that a replacement photographer cannot be found in time, a full refund will be given to you.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
You may cancel this contract at any point by giving me written notice via recorded mail or email. Cancellations made over 8 weeks before the wedding date will forfeit only the booking fee amount. For cancellations less than 8 weeks before the wedding, you will forfeit the booking fee amount and will still be required to pay the full remaining balance prior to the proposed wedding date. If you choose to postpone your wedding (as opposed to cancelling), you may use the booking fee paid to secure a new date within 12 months of your original wedding date (at no extra cost), subject to my availability.
